DiamondPilot Terms

1. Service and operator

DiamondPilot LLC operates DiamondPilot from Missouri, United States. In these Terms, “DiamondPilot,” “we,” “us” and “our” mean DiamondPilot LLC, and the “Service” means DiamondPilot's account-based team, planning, Game Day and season-information services. These Terms describe the conditions for using the Service. DiamondPilot is currently in development.

2. Eligibility

DiamondPilot accounts are intended for adults age 18 or older, including coaches and team administrators. Players are roster records, not authenticated account holders under the current product. An adult account rule does not by itself resolve all responsibilities concerning youth-player information.

3. Account security

Use accurate account information, protect your credentials and devices, and contact support if you suspect unauthorized access. Do not share passwords, authentication tokens or recovery links.

4. Team and player information

Enter and share information only when you have the necessary rights and authority. You are responsible for the accuracy and appropriateness of the information you submit, including youth-player information. Provide only information reasonably needed for team management and avoid unnecessary sensitive information.

5. Coaching decisions and player safety

Plans, warnings and season summaries support coaching decisions; they do not replace coaching judgment, league rules, supervision or player-safety decisions. DiamondPilot does not guarantee fairness, playing time, league-rule compliance, player development or performance. It is not a medical service and does not provide medical advice or injury-prevention guarantees.

6. Shared Game Plans

Anyone possessing a valid Shared Game Plan bearer link may view its supported information without signing in, including player and Guest names and game-plan information. You are responsible for choosing recipients and having authority to share the information. Recipients can forward links, copy information or take screenshots. Expiration and revocation cannot retrieve copies already made by others.

7. Acceptable use

Use the Service lawfully and with respect for others' privacy and rights. Do not misuse accounts, attempt unauthorized access, disrupt the Service or submit material you are not entitled to use.

8. User content

You retain whatever rights you have in information or content you submit. DiamondPilot does not claim ownership of team, player or game information. Submitting information does not give you ownership of another person's personal information or eliminate their rights.

You give DiamondPilot a nonexclusive permission to host, store, reproduce, process and display submitted information, and to share it as you direct through supported features, only as reasonably necessary to operate, secure, maintain, improve and support the Service. Providers may handle it on our behalf for those purposes. This permission is not a right to sell player information or use it for unrelated advertising. It lasts only as needed for those purposes and the retention and deletion practices described in the Privacy Policy, including limited continued handling of backups or logs. You must have the authority needed to grant this permission.

9. DiamondPilot intellectual property

DiamondPilot's application, branding and related materials are distinct from information you submit. Using the Service does not transfer ownership of those materials to you. Rights in third-party materials remain with their respective owners.

10. Free and Pro features

DiamondPilot includes Free functionality and additional Pro features. Feature availability depends on the supported product and account access. Purchases and Apple subscription purchasing are not implemented in this version. Any future purchasing flow will require applicable purchasing terms before it is offered.

11. Service availability

The Service relies on network access and external providers and may be unavailable or change during development. Local drafts are not a substitute for a successful server save. Review plans and saved information before relying on them.

12. Suspension and termination

We may restrict or end access when reasonably necessary to address security risks, unlawful or unauthorized use, or material violations of these Terms. You may stop using the Service and initiate account deletion through Settings. Contact support with questions about access or deletion.

13. Account deletion

Signed-in users can initiate account deletion in Settings. Contact support if you cannot access the account. A failed or interrupted deletion response may leave the outcome uncertain; it does not necessarily mean nothing was deleted. Deletion cannot retrieve copies others retained or promise immediate erasure from all provider backups, logs or support correspondence. Account deletion must not be assumed to cancel any future Apple subscription; any future billing flow will need separate cancellation instructions.

14. Third-party services and app licenses

Hosting, authentication and other providers operate services used by DiamondPilot. Their applicable terms may govern your interactions with them. See the Privacy Policy for the provider inventory.

These are DiamondPilot service/account Terms, not a custom Apple application license. If an iOS app is distributed through the App Store using Apple's standard Licensed Application End User License Agreement, that agreement also applies according to its scope. These Terms do not replace or amend that app license or remove mandatory rights under applicable law.

15. Feedback

If you voluntarily send feedback or suggestions, you permit us to use them to maintain and improve DiamondPilot. This permission does not transfer ownership of your team/player data or authorize unrelated use of confidential information. Please do not include personal player information or other confidential material in feedback unnecessarily.

16. General disclaimers

DiamondPilot's plans and analysis are tools for a coach's review and judgment, not promises of particular outcomes. Availability, information and generated plans may contain errors or omissions. Nothing in these Terms removes warranties or consumer rights that applicable law does not allow to be excluded.

17. Limitation of liability

To the fullest extent permitted by applicable law, DiamondPilot LLC and its owners, officers, employees, agents, affiliates, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or relating to your access to or use of, or inability to access or use, the Service.

To the fullest extent permitted by applicable law, the total aggregate liability of DiamondPilot LLC arising out of or relating to the Service or these Terms will not exceed the greater of $100 or the amount you paid to DiamondPilot for the Service during the 12 months immediately preceding the event giving rise to the claim.

The limitations in this section apply regardless of the legal theory on which a claim is based and even if DiamondPilot has been advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.

18. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless DiamondPilot LLC and its owners, officers, employees, agents, and affiliates from and against third-party claims, liabilities, damages, losses, and reasonable costs and expenses, including reasonable attorneys' fees, arising out of or relating to:

• your unlawful or unauthorized use of the Service;
• your material violation of these Terms;
• your infringement or violation of another person's rights; or
• information or content that you submit, enter, or share through DiamondPilot without the rights or authority necessary to do so.

DiamondPilot will provide reasonable notice of a covered claim and reasonable cooperation in its defense. You may not settle a claim in a manner that admits liability on behalf of DiamondPilot LLC or imposes obligations on DiamondPilot LLC without our prior written consent.

19. Governing law and disputes

These Terms and any dispute arising out of or relating to these Terms or the Service will be governed by the laws of the State of Missouri, without regard to its conflict-of-laws principles, except to the extent applicable law requires otherwise.

Subject to any rights you may have under applicable consumer-protection law, any legal action or proceeding arising out of or relating to these Terms or the Service will be brought in an appropriate state or federal court located in Missouri, and you and DiamondPilot LLC consent to the jurisdiction of those courts.

Nothing in this section prevents either party from seeking relief in small claims court where eligible or from seeking appropriate temporary or injunctive relief where permitted by law.

These Terms do not require mandatory arbitration.

20. Changes

Changes to these Terms will be posted with an updated effective date. Any notice or consent required by applicable law will be handled before a change takes effect as required.
